Antitrust / Competition

Overview

Competition laws are a vital aspect of the Indian business environment, designed to ensure fair and healthy competition and prevent anti-competitive and abusive practices that harm the market and consumer welfare. Our legal advisory extends across a full range of competition law matters including cartel enforcement, abuse of dominance, merger control, leniency applications, competition law audits and compliance.

Our lawyers regularly engage with the Competition Commission of India (CCI) and the investigative arm of the CCI, i.e., the office of the Director General (DG) for competition law related matters. We also represent clients in competition appeals before the National Company Law Appellate Tribunal (NCLAT) and the Supreme Court of India.

In the competition law space, we have showcased a strong domain expertise across various sectors such as stock exchange, cement, automobile, retail, financial services, telecommunications, e-commerce, aviation, auto-parts, pharmaceuticals, transportation, information technology and the media.

Our antitrust team has extensive experience advising MNCs and domestic companies on complex competition law matters, involving advising on issues such as predatory pricing, tying and bundling, exploitative and exclusionary practices, price parity / most favored nation issues, preferential treatment, loyalty inducing or fidelity rebates, price discrimination, refusal to supply, margin squeeze, exclusivity agreements, and resale price maintenance. Our team has also been successful in seeking approval from the competition regulator for complex mergers and acquisitions within quick timelines. We understand that competition laws can be complex and challenging, and we are committed to providing our clients with innovative solution-oriented legal advice in a timely manner.

Our team works closely with our General Corporate and M&A teams to provide comprehensive legal services to our clients.
