The discussion explored the practical realities of resolving disputes between Indian and Japanese businesses, with a particular focus on international arbitration. Gauhar shared insights from the Indian perspective on procedural and evidentiary considerations, remote hearings, the role of the seat court, and the enforcement of arbitral awards.
The panel also examined how arbitration can effectively bridge differences in legal systems, business practices, and commercial expectations as economic ties between India and Japan continue to deepen, highlighting the importance of anticipating dispute-related issues at the contracting stage itself.
